Refunds / Returns under Guarantee
Our Guarantee is valid providing you have complied with the following conditions:-

If you are unhappy with your purchase we will replace or refund the items concerned at our discretion. This does not affect your statutory rights as a consumer. Please inform us of any problems within 7 working days of receiving your order. Please FAX (01205751255) or us for an immediate resolution to your problem. We are unable to offer a refund for personalised orders, special orders or orders for items not available on our website.

Where your order is to be returned to us for a full refund, we do not accept liability for the return carriage costs incurred. If the order is to be refunded we will issue a refund within 30 days. If a return is arranged, a deduction will be made from the refund to cover the cost of collecting the goods. However, if returning faulty goods we will issue a refund for the return postage costs incurred. When returning goods please ensure that the products are unopened, please also include the following items, your invoice number, payment transaction number, purchase date and any gift included with your goods (gift is valued by us at £5.00). Without all these requirements we will be unable to offer you a refund.

Any goods deemed to be perishable will not be refunded as per the DSR also any seasonal products will not be refunded eg. Christmas, Easter, Valentines Day, Mothers Day or Farthers Day. In such instances, we shall have the right at our sole discretion to refuse the return if in our opinion it is not justified. Under these circumstances, the goods will be returned to you at your cost. Any 'non faulty' goods returned for a refund will be refunded minus delivery, return delivery and transaction costs (£1.50 min). We are unable to refund customised goods ie Gift Wrapping. A restocking fee of 15% may be charged for returned goods.

All prices shown are in UK Pounds, VAT is included in the price. We reserve the right at any time to revise prices to account for any increases in costs including the increase or imposition of any duty, tax, levy or exchange rate variation. We will take all reasonable steps to notify you of any relevant revision of prices before processing your order.

4) Delivery - Royalmail, Parcelforce48, Priority Courier
Royalmail will attempt to deliver your order once, after that you are expected to collect your parcel from your local sorting office within 5 days.

Parcelforce will automatically attempt to deliver your item twice. If you were out the first time, delivery will be attempted the next working day. If you would like to collect your parcel instead of it being attempted again, please tell Parcelforce by using their"collect" option on Parcelforces website. This needs to be done by 6pm the day the first attempt was done to ensure it does not go out on a delivery vehicle the next day.

Priority Courier delivery service will attempt to deliver your order twice, after this time you agree to follow the instructions on the calling card issued when delivery cannot be made.

We will take all reasonable steps to deliver your order within the time indicated on our Delivery Information web page. However, we will not be under any liability to you in respect of any failure to deliver within this timescale or on any particular day or dates. Title to the goods passes to you once your consignment is delivered by our nominated carrier(s). For health and safety reasons goods may not be collected in person. Orders with priority courier must be placed with us by 1am the day before you wish to receive you order. Orders received after 1am may be dispatched the following day excluding weekends and public holidays. Customers who use our Courier Delivery service or Parcelforce48 MUST provide a full delivery address and postcode where the order can be accepted and signed for. i.e. your home, a neighbour or your workplace. You agree not to hold MTL Marketing/Britishcandy.com responsible for late delivery.

4.1) Missing or lost in the post standard Royalmail delivery
Royalmail class parcels as missing once 15 working days have elapsed from the expected delivery date. If you feel your order has been lost in the post you must stating that your order has been lost in the post and please include all the following information, your invoice number, payment transaction number and purchase date. Once your parcel is deemed missing we will either issue you with a full refund or replacement goods at our discretion.

4.2) Undelivered/non acceptance of parcels

ouriers will leave a calling card if you not available to accept your parcel, you agree to call them as soon as possible with the details on the card and/or collect your parcel within 2 days, your parcel will be available for collection between 19.00-20.00 the same day as they tried to deliver or 08.00-20.00 monday-friday,and 08.00-12.00 saturday, you must take the card with you and some proof of identity i.e driving licence,passport,cheque guarantee card otherwise your parcel will not be released to you. After 2 days have elapsed your parcel will be returned to us, which we have to pay for. The cost of redelivery is £12.00. Payments must be made before your parcel can be redelivered. If you do not want your order to be redelivered, you will be refunded minus delivery, return delivery and a minimum of £1.50 transaction fee, also a restocking fee of 15% may be charged for returned goods.

4.3) Missing orders outside the UK
Royalmail class parcels as missing once 15 working days have elapsed from the expected delivery date. If you feel your order has been lost in the post you must us stating that your order has been lost in the post and please include all the following information, your invoice number, payment transaction number and purchase date. Once your parcel is deemed missing we will either issue you with a full refund or replacement goods at our discretion.

4.4) Missing or lost UK Priority Courier Service/Parcelforce48 delivery items
If you feel your order has been lost by Citylink or Parcelforceyou must e-mail stating that your order has been lost. Please include all the following information, your invoice number, payment transaction number and purchase date. Once your parcel is deemed missing we will either issue you with a full refund or replacement goods at our discretion.

4.5) Incomplete Delivery Address or Incorrect Delivery Address
It is the customers responsibility to provide a full and correct delivery address including the postcode. MTL Marketing/Britishcandy.com will not be held responsible for orders which become lost due to an incomplete or incorrect delivery address.
If your order is returned to us due to this reason and you do not want your order to be redelivered, you will be refunded minus delivery, return delivery and a minimum of £1.50 transaction fee.

4.6) Force majeure
No Party shall be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity [or telephone service], and no other Party will have a right to terminate this Agreement under Clause 2 and 2.1 (Termination) in such circumstances

WorldPay Security Statement
Security is probably one of the most significant concerns for both the consumer and the merchant during an online transaction. In reality an online transaction is probably more secure than a card transaction in a shop or conducted over the telephone or by fax. Information transmitted online is encrypted using complicated logarithm combinations unlike these other methods that use standard medium coding.

The WorldPay Select payment gateway uses a combination of both established and innovative techniques to ensure the security and integrity of all sensitive data, protecting both the merchant and their customers.

All communication between the customer and WorldPay is encrypted to the maximum strength supported by the customer's browser using: TLS or SSL (security)

Our public web servers are certified by Thawte, a public Certificate Authority ensuring that customers and merchants alike can have confidence that nobody can impersonate WorldPay to obtain confidential information.

All communication between the merchant and WorldPay, including the details of the purchase are encapsulated using our own encrypted and digitally-signed protocol. This uses a combination of standard methods such as PGP, RSA and MD5 to ensure that the information passed is secure and tamper-proof.

Data storage on WorldPay systems, and the communication between WorldPay and the worldwide banking networks, is regularly audited by the banks themselves. There are no vulnerabilities or 'back doors' in any WorldPay systems. We ensure that we stay up to date with the latest versions of any third-party code we use, and continually review our own proprietary code, using current best practice at all times.

In addition card issuers protect cardholders from fraudulent use of their card in a card not present environment, such as over the Internet or telephone. As the customer did not sign for the goods they have the absolute right to demand a chargeback if those goods didn't arrive or the card was used fraudulently.

WorldPay also insure all of our merchants against the risk of them going out of business. If one of WorldPay’s online merchants goes into receivership WorldPay protects the cardholder by directly refunding any debits onto their card.

These two combined allow complete protection for a cardholder.
